Article 1: Glossary
1.1 You, your
The person who has concluded the insurance agreement with the insurers.
1.2 Insured
You and the persons named in the Special Conditions or on the policy schedule.
1.3 Endema Keijzers
Endema Keijzers who mediated in the establishment of the insurance.
1.4 Insurers
The insurance company/companies with which you have concluded the insurance agreement.
1.5 Fraud
The deliberate provision of incorrect information with the intent to mislead insurers when applying for insurance or when requesting compensation for damage.
Article 2: What are your obligations in case of damage?
2.1
You must:
- report the damage as quickly as possible;
- provide all items of evidence, data and documents as quickly as possible;
- make no promise or statement to another party that you wish to pay;
- not make any statement regarding blame;
- provide all information necessary to prove your right to compensation or assistance;
- fully cooperate in the handling of the damage and do nothing that could harm the interests of the insurers;
- in case of theft or attempted theft, burglary, embezzlement, joyriding, vandalism or loss, file a report with the police or another competent authority. You must provide written proof of this report to the insurers.
2.2 What happens if you do not fulfill an obligation?
The insurers will not compensate any damage if you do not fulfill an obligation, or do not do so on time, and thereby harm their interests.
Article 3: Are you doubly insured?
3.1
If you have damage that is also covered by another insurance policy, you must let the insurers know which insurance policy that is.
3.2
You or any other insured person will not receive compensation for damage that you or any other insured person can obtain through another insurance policy, scheme or law. This also applies if you could have received that compensation if you had not had this insurance policy.
Article 4: When does a claim expire?
If insurers definitively reject the compensation of a claim (or a part of it), the claim against insurers expires three years after the date of rejection. A claim is then no longer legally enforceable.
Article 5: The premium
5.1 When must you pay the premium?
You must pay the premium, the costs and the insurance premium tax in advance. The premium invoice states when the payment must be received.
5.2 What happens if you do not pay the premium or do not pay it on time?
5.2.1
If you do not pay the first premium on time, the cover will automatically cease after 30 days;
5.2.2
If you do not pay a subsequent premium on time, you will receive a payment reminder and then a demand for payment. If you have still not paid two weeks after the demand was sent, there will be no further cover from the day after that;
5.2.3
You are obliged to pay the premium anyway. The cover starts again on the day after the day on which the outstanding premium has been received and accepted by the insurers.
5.3 When do you get a premium refund?
In the event of cancellation of the insurance, you will receive a reasonable premium refund from the date of termination.
Article 6: When may insurers change the premium and/or conditions?
6.1 Upon renewal of the insurance
Insurers can adjust the premium and/or conditions annually. The adjustment will then take effect on the annual renewal date of the insurance. If the premium and/or conditions change, you will receive a notification with information about the change.
If you do not agree with the change, you can cancel the insurance within 30 days. The insurance then ends on the day the adjustment takes effect. If the cancellation is made after the date of adjustment but within the 30-day term after the notification, the insurance ends on the date of your cancellation. If we do not hear from you, we assume that you agree with the change.
6.2 During the term of the insurance
Insurers have the right to change the premium and/or conditions of one or more types of insurance in the interim for all insured persons at the same time. If the premium and/or conditions change, you will receive a notification with information about the change.
If you do not agree with the change, you can cancel the insurance within 30 days. If we do not hear from you, we assume that you agree with the change.
Article 7: Commencement, cooling-off period and end of the insurance
7.1 When does the insurance start?
The insurance starts on the commencement date shown on your policy schedule. The insurance has a contract duration of one year. After each year we renew the insurance for one year.
7.2 Do you not want the insurance?
If you do not want the insurance, please let us know within 14 days of receiving the policy document. The insurer will then terminate your insurance free of charge.
7.3 When can you cancel the insurance?
You can cancel your insurance on a daily basis with a notice period of one month.
7.4 When can insurers cancel the insurance?
Insurers can cancel the insurance every year on the contract expiry date with a notice period of two months. Furthermore, insurers can cancel if:
7.4.1 insurers discover that you did not provide all or correct information about your situation when applying for the insurance. If you did this intentionally to mislead the insurers, the insurance ends immediately.
The insurance also ends immediately if the insurers would not have accepted the insurance if you had provided the correct information;
7.4.2 insurers are aware of an event for which they may have to pay compensation, or after they have compensated or rejected a claim. Insurers can then terminate the insurance within a month with a notice period of two months. The notice period does not apply if you have intentionally misled the insurers;
7.4.3 you do not pay the premium, or do not pay it on time. Insurers can then terminate the insurance with a notice period of two months.
Article 8: Which exclusions and limitations apply?
8.1
Insurers do not compensate the damage if:
8.1.1 the event or accident was caused by or arose from acts of war. Insurers understand acts of war to mean:
- armed conflict: when states or organized groups fight each other (or one another) with weapons or military means. This also includes the armed action of a United Nations Peacekeeping Force;
- civil war: a violent struggle between several residents of the same state;
- uprising: organized violent resistance within a state, directed against public authority;
- civil commotion: organized violent acts in various places within a state;
- riot: an organized local violent movement, directed against public authority;
- mutiny: an organized violent movement of members of an armed force, directed against public authority;
8.1.2 the event or accident was caused by, occurred during, or resulted from nuclear reactions. Nuclear reactions are understood to mean any nuclear reaction in which energy is released, such as nuclear fusion, nuclear fission, artificial and natural radioactivity;
8.1.3 the insured commits fraud or deception or intentionally makes untrue or incomplete statements regarding a claim or has them made.
8.2
Insurers compensate damage caused by terrorism in accordance with the Terrorism Cover Clause Sheet at the Dutch Reinsurance Company for Terrorism Claims N.V. (NHT). This states that insurers may limit the compensation for damage in the event of terrorism, malicious contamination and the like. More information can be found at www.terrorismeverzekerd.nl.
Article 9: Which laws and regulations apply to this agreement?
This agreement is governed by Dutch law.
Article 10: Which address do insurers use to inform you?
Insurers inform you properly in accordance with the law if they send their information to "Endema Keijzers". "Endema Keijzers" informs you via the most recent (email) address known to them.
Article 11: What do insurers do with your personal data?
When you want to apply for or change an insurance policy, personal data and any other details are requested. Insurers and/or "Endema Keijzers" use this data to conclude and manage the insurance contract. This data is also used to combat fraud. In addition, this data is used to keep you informed of our products and services.
The Code of Conduct for the Processing of Personal Data by Financial Institutions applies to the processing of personal data (see www.verzekeraars.nl). This code of conduct applies to all insurers. Insurers exchange your claim and insurance data with the Stichting Centraal Informatie Systeem (CIS) in The Hague. This is to ensure a responsible policy regarding claims and acceptance of insurance. The privacy regulations of the Stichting CIS apply (see www.stichtingcis.nl).
Article 12: Sanctions legislation and regulations
If the sanctions legislation and/or regulations prohibit the insurers from providing insurance cover or compensation, the insurers are therefore not permitted to provide insurance cover or pay compensation under this insurance.
Article 13: Special insurance conditions
1 Glossary
1.1 Event
An incident or a series of related incidents that caused damage.
1.2 Damage
Damage is understood to mean damage to persons and damage to property.
1.2.1 Damage to persons is understood to mean damage due to injury or harm to health, whether or not resulting in death, including consequential damage.
1.2.2 Damage to property is understood to mean damage due to the damage or loss of property belonging to persons other than the insured, including consequential damage.
1.3 Joyriding
Joyriding is understood to mean driving a motor vehicle without the permission of the owner or keeper and without the intention to appropriate this motor vehicle.
1.4 Intent
Intent is understood to mean the deliberate targeted act and/or omission against a person or an object without the insured having the right to do so. Even if the insured never wanted the consequences of the act and/or omission.
2 Who are insured?
2.1 If the policy schedule states that this insurance applies to a multi-person household, then the following are insured:
2.1.1 you;
2.1.2 your spouse or registered partner;
2.1.3 your cohabiting unmarried children, including foster and stepchildren;
2.1.4 your adult unmarried children, including foster and stepchildren, if they are living away from home to follow an education;
2.1.5 other persons with whom you live together permanently and as a family unit;
2.1.6 your grandparents, parents, foster parents, parents-in-law and unmarried relatives living with you;
2.1.7 guests. Only if their liability is not covered by another insurance policy;
2.1.8 domestic staff during the work they perform for you.
2.2
If the policy schedule states that this insurance applies to a single-person household, then only the following are insured:
2.2.1 you;
2.2.2 guests. Only if their liability is not covered by another insurance policy;
2.2.3 domestic staff during the work they perform for you.
3 Capacity in which insured
3.1
The liability of the insured as a private person is covered. Damage caused during the exercise of a (ancillary) business or (ancillary) profession and the performance of paid work is not covered.
3.2
These limitations of capacity do not apply to:
3.2.1 Domestic staff as described in art. 2;
3.2.2 insured persons as described in art. 2.1.4 to 2.1.6 when they perform work for others than the insured during holidays, free time or within the framework of an education, whether or not for payment. In this case, the liability of these children is only covered if their liability is not covered by another insurance policy. Claims of the employer are not covered;
3.2.3 insured persons who perform unpaid volunteer work for others than the insured.
4 What is covered?
4.1 Liability
The liability of the insured persons for damage caused or arisen during the term of the insurance is covered, and this is for all insured persons together up to a maximum of the amount stated on the policy schedule per event.
Liability for damage caused during the term but arising after the end of the insurance is covered, but only if the liability for this damage is not covered by another insurance policy.
4.2 Mutual liability
Liability for damage caused by an insured person to another insured person is covered. Insurers only compensate damage to persons. Damage to property is not covered. Only the injured insured person themselves or a surviving relative of this insured person will receive compensation.
If the domestic staff has an accident at work while performing work for you, insurers will compensate damage to persons in addition to damage to property.
Does the policy schedule state that the insurance applies to a single-person household? And the insured causes damage to another person with whom the insured lives together permanently and as a family unit? Then insurers only compensate damage to persons. And only if the damage is not covered by another insurance policy.
4.3 Friendly service
Damage caused by the insured when performing a friendly service (favor) is covered. This concerns damage to the person or property of the person for whom the insured is performing the friendly service.
By friendly service, insurers mean work that the insured performs for another private person, without being paid for it.
Insurers compensate this damage up to a maximum of EUR 12,500 per event, but only if:
- the friendly service is performed for someone other than an insured person, and
- the insured would be liable if there were no friendly service, and
- the damage was not caused by the injured party's own fault, and
- the compensation is requested by the person who was helped with the friendly service, or a surviving relative of that person.
4.4 Defense in human civil proceedings
Are you held liable for damage and must you defend yourself against this in civil proceedings? Then insurers will compensate the costs. There is no maximum for this. However, insurers must be in charge of this process.
4.5 Statutory interest
Insurers compensate the statutory interest you have to pay. There is no maximum for this. Is the total damage higher than the insured amount for liability? Then insurers will not pay statutory interest on the amount above the insured amount.
4.6 Guarantee deposit
Does a competent authority request a guarantee deposit to secure the rights of the injured party in the event of insured damage? Then insurers can advance this guarantee deposit. Insurers pay the guarantee deposit up to a maximum of 10% of the insured sum.
If insurers advance the guarantee deposit, you are obliged to authorize insurers to recover the guarantee deposit when it is released. And furthermore, to provide all cooperation to get it fully repaid.
Is the guarantee deposit not released? Then you must repay it to insurers as quickly as possible, but at the latest within 12 months.
5 Immovable property
5.1
For immovable property, only your liability or that of the cohabiting insured persons is covered:
5.1.1 as the owner-occupier of the home including the associated outbuildings in which you live, even if part of it is rented out;
5.1.2 as the owner of the home that is no longer occupied by you, but which you still own;
5.1.3 as the owner of the home that you own, but where you do not yet live;
5.1.4 as the owner of a holiday home, mobile home, cabin on an allotment garden complex or a second home located in Europe. But only if you occupy it yourself and do not rent it out exclusively to third parties;
5.1.5 for damage caused by the home under construction in which you will live yourself. But only if the liability for the damage is not covered by another insurance policy.
5.2 Liability for damage caused by immovable property that you rent out is not covered.
6 What is not covered?
The General Terms and Conditions state the general exclusions. In addition, insurers do not compensate damage in the following situations:
6.1 Intent
Liability for damage is not covered
- which the insured causes intentionally.
- which someone causes with the approval of the insured.
- which is caused intentionally by one or more persons from a group to which the insured belongs. It does not matter that the insured did nothing themselves. Nor does it matter if the insured or others from the group were under the influence of alcohol, medicines or drugs.
6.2 Sexual conduct
Liability is not covered:
- of an insured person for damage caused by and/or arising from his/her sexual or sexually tinted conduct of any nature whatsoever.
- of an insured person belonging to a group for damage caused by and/or arising from sexual or sexually tinted conduct of any nature whatsoever of one or more persons belonging to the group. Even if the insured did not behave as such themselves.
6.3 Custody (Opzicht)
6.3.1 Liability for damage to property belonging to someone else that of which the insured has custody (opzicht) is not always covered. Damage to the following property is not covered:
6.3.1.1
to property (excluding animals) which the insured or someone on behalf of the insured has in their possession on the basis of:
- a rental agreement;
- a hire-purchase agreement;
- a lease agreement;
- a (ground) lease agreement;
- a pledge agreement;
- usufruct;
- the right of use and habitation
- the exercise of an (ancillary) business;
6.3.1.2 to property which the insured or someone on behalf of the insured has unlawfully in their possession.
6.3.1.3 to motor vehicles, (mobile) homes, motor and sailing vessels (including sailboards) and aircraft, which an insured person or someone on behalf of the insured has in their possession;
6.3.1.4 which consists of and/or is the result of loss, theft or misplacement of money, securities, bank, giro or payment cards or credit cards, which an insured person or someone on behalf of the insured has in their possession.
6.3.2 The exclusions mentioned in articles 6.3.1.1 to 6.3.1.3 do not apply in the following situations:
- 6.3.2.1 if damage is caused to a home or (mobile) home rented by the insured by a (satellite) antenna attached by the insured to that rented home or (mobile) home;
- 6.3.2.2 if damage is caused to a home, (mobile) home, trailer, folding caravan, boat trailer rented by the insured by fire, fire extinguishing or explosion. This also applies if this causes damage to property belonging to the home and (mobile) home rented by the insured;
- 6.3.2.3 if damage is caused to the holiday accommodation rented by the insured by water unexpectedly flowing from pipes, installations and appliances in the holiday accommodation. This also applies if this causes damage to property belonging to the holiday accommodation rented by the insured;
6.3.2.4 if the insured, as a passenger of a means of transport, causes damage to that means of transport. This only applies if the insured does not have a rental, hire-purchase, lease or other agreement for that means of transport.
6.3.3 The liability of the insured for damage to a motor vehicle with which joyriding has been committed is not covered. Is the person who caused this damage under 18 years of age? Then the damage to that motor vehicle is covered. Insurers compensate this damage up to a maximum of EUR 5,000 per event.
6.3.4 Is the insured liable for damage caused to someone else's property that the insured has custody of (opzicht)? And does this concern a different situation than stated in art. 6.3.1 to 6.3.3? Then insurers compensate the damage up to a maximum of EUR 12,500 per event.
6.3.5 Insurers will not invoke the exclusions and limitations regarding custody as described in art. 6.3.1 to 6.3.4, in case of liability for damage caused by an insured person who is under 14 years of age, unless an insured person of 14 years or older also has the property under custody.
6.4 Motor vehicles
6.4.1 Liability for damage caused with or by a motor vehicle owned, possessed, kept, driven or used by an insured person is not covered.
6.4.2 This exclusion does not apply in the following cases:
6.4.2.1 if the insured causes damage as a passenger of a motor vehicle. However, Art. 4.2 (mutual liability) and art. 6.3 (custody) remain fully applicable;
6.4.2.2 if your domestic staff and the insured persons mentioned in art. 2.1.2 and 2.1.3 cause damage with their own motor vehicle during the work they perform for you;
6.4.2.3 if the insured causes damage with lawnmowers, children's toys or other utensils with a motor. But only if these cannot drive faster than 10 km per hour. Liability for damage caused with remote-controlled model cars is also covered.
6.4.2.4 if the insured causes damage with or by a bicycle with electric pedal assistance for which no insurance obligation applies;
6.4.2.5 if the insured causes damage during joyriding with a motor vehicle. But only if the person who caused the damage is under 18 years of age. And the cause of the damage moreover did not want to steal or embezzle the motor vehicle.
Is there joyriding without violence? And does the owner of the motor vehicle have liability insurance for their motor vehicle? Then the liability for damage caused with or by the motor vehicle is not covered.
6.4.3 The cover described under art. 6.4.2.1 to 6.4.2.5 does not apply if the liability is covered by another insurance policy.
6.5 Vessels
6.5.1 Liability for damage to property caused with or by vessels is not covered.
6.5.2 This exclusion does not apply in the following cases:
6.5.2.1 if the insured causes damage as a passenger of a vessel. However, Art. 4.2 (mutual liability) and art. 6.3 (custody) remain fully applicable;
6.5.2.2 if the insured causes damage with or by:
- a rowboat, canoe or other vessel without a motor;
- a model boat, even if it is remote-controlled;
- a vessel that has an (outboard) motor with a power of 3 kilowatts or less (3 kilowatts is approximately 4 hp) and cannot sail faster than 20 km per hour;
- a sailboard and sailboat whose sail area is not larger than 16m2;
- a houseboat without a motor.
6.5.3 Liability for damage caused with or by a vessel that has an (outboard) motor and can sail faster than 20 km per hour is not covered.
6.5.4 The cover described under art. 6.5.2.1 and 6.5.2.2 does not apply if the liability is covered by another insurance policy.
6.6 Aircraft
6.6.1 Liability for damage caused with or by an aircraft is not covered. This also applies to damage caused with or by a:
- a model airplane;
- a glider;
- a target aircraft;
- a paraglider;
- a kite (tethered);
- an airship;
- a model rocket;
- a hovercraft;
- a hot air balloon whose diameter is larger than 1 m.
6.6.2 This exclusion does not apply in the following cases:
6.6.2.1 if the insured causes damage as a passenger of an aircraft. However, Article 4.2 (mutual liability) and art. 6.3 remain fully applicable;
6.6.2.2 if the insured causes damage with or by model airplanes that weigh 20 kg or less;
6.6.3 The cover described under art. 6.6.2.1 and 6.6.2.2 does not apply if the liability is covered by another insurance policy.
6.7 Residence not in the Netherlands
6.7.1 The liability of an insured person who no longer has his/her residence in the Netherlands is not covered. The insurance ends for him/her 30 days after departure.
6.7.2 This exclusion does not apply to guests and domestic staff.
6.8 Weapons
Liability for damage caused in connection with the possession and/or use of weapons as referred to in the Weapons and Ammunition Act, for which the insured does not have a license, is not covered.
Liability for damage caused in connection with the possession and/or use of firearms during hunting is not covered. Even if the insured has a license for this.
7 Handling of a claim
7.1 Claims settlement
Insurers have the right to settle claims of the injured party directly with that injured party. Insurers can compensate the damage directly to the injured party or reach a settlement with the injured party. In doing so, insurers take your interests into account.
7.2 Compensation
Does the compensation of damage consist of periodic payments? And is the value of the payments, taking into account any other compensation, higher than the insured amount? Then the duration or the level of those payments will be reduced proportionally.
8 What happens in the event of death?
8.1
If you pass away and the policy schedule states that this insurance applies to a multi-person household, the following rules apply:
8.1.1 Did you have a spouse or partner? Then the insurance continues unchanged in the name of this spouse or partner.
If the spouse or partner does not wish to continue the insurance, they must let the insurers know within three months of death.
The insurance then ends on the date indicated by them;
8.1.2 Did you not have a spouse or partner? But you do have children under 18 years of age? And is there a guardian for these children? Then the insurance continues unchanged in the name of this guardian.
If the guardian does not wish to continue the insurance, they must let the insurers know within three months of death.
The insurance then ends on the date indicated by them;
8.1.3 Did you not have a spouse or partner? And also no children under 18 years of age? Then the insurance ends at the end of the period for which the last premium was paid.

Insurers can cancel the insurance every year on the contract expiry date with a notice period of two months. Furthermore, insurers can cancel if:
7.4.1 insurers discover that you did not provide all or correct information about your situation when applying for the insurance. If you did this intentionally to mislead the insurers, the insurance ends immediately.
The insurance also ends immediately if the insurers would not have accepted the insurance if you had provided the correct information;
7.4.2 insurers are aware of an event for which they may have to pay compensation, or after they have compensated or rejected a claim. Insurers can then terminate the insurance within a month with a notice period of two months. The notice period does not apply if you have intentionally misled the insurers;
7.4.3 you do not pay the premium, or do not pay it on time. Insurers can then terminate the insurance with a notice period of two months.
Article 8: Which exclusions and limitations apply?
8.1
Insurers do not compensate the damage if:
8.1.1 the event or accident was caused by or arose from acts of war. Insurers understand acts of war to mean:
- armed conflict: when states or organized groups fight each other (or one another) with weapons or military means. This also includes the armed action of a United Nations Peacekeeping Force;
- civil war: a violent struggle between several residents of the same state;
- uprising: organized violent resistance within a state, directed against public authority;
- civil commotion: organized violent acts in various places within a state;
- riot: an organized local violent movement, directed against public authority;
- mutiny: an organized violent movement of members of an armed force, directed against public authority;
8.1.2 the event or accident was caused by, occurred during, or resulted from nuclear reactions. Nuclear reactions are understood to mean any nuclear reaction in which energy is released, such as nuclear fusion, nuclear fission, artificial and natural radioactivity;
8.1.3 the insured commits fraud or deception or intentionally makes untrue or incomplete statements regarding a claim or has them made.
8.2
Insurers compensate damage caused by terrorism in accordance with the Terrorism Cover Clause Sheet at the Dutch Reinsurance Company for Terrorism Claims N.V. (NHT). This states that insurers may limit the compensation for damage in the event of terrorism, malicious contamination and the like. More information can be found at www.terrorismeverzekerd.nl.
Article 9: Which laws and regulations apply to this agreement?
This agreement is governed by Dutch law.
Article 10: Which address do insurers use to inform you?
Insurers inform you properly in accordance with the law if they send their information to "Endema Keijzers". "Endema Keijzers" informs you via the most recent (email) address known to them.
Article 11: What do insurers do with your personal data?
When you want to apply for or change an insurance policy, personal data and any other details are requested. Insurers and/or "Endema Keijzers" use this data to conclude and manage the insurance contract. This data is also used to combat fraud. In addition, this data is used to keep you informed of our products and services.
The Code of Conduct for the Processing of Personal Data by Financial Institutions applies to the processing of personal data (see www.verzekeraars.nl). This code of conduct applies to all insurers. Insurers exchange your claim and insurance data with the Stichting Centraal Informatie Systeem (CIS) in The Hague. This is to ensure a responsible policy regarding claims and acceptance of insurance. The privacy regulations of the Stichting CIS apply (see www.stichtingcis.nl).
Article 12: Sanctions legislation and regulations
If the sanctions legislation and/or regulations prohibit the insurers from providing insurance cover or compensation, the insurers are therefore not permitted to provide insurance cover or pay compensation under this insurance.
Article 13: Special insurance conditions
1 Glossary
1.1 Event
An incident or a series of related incidents that caused damage.
1.2 Damage
Damage is understood to mean damage to persons and damage to property.
1.2.1 Damage to persons is understood to mean damage due to injury or harm to health, whether or not resulting in death, including consequential damage.
1.2.2 Damage to property is understood to mean damage due to the damage or loss of property belonging to persons other than the insured, including consequential damage.
1.3 Joyriding
Joyriding is understood to mean driving a motor vehicle without the permission of the owner or keeper and without the intention to appropriate this motor vehicle.
1.4 Intent
Intent is understood to mean the deliberate targeted act and/or omission against a person or an object without the insured having the right to do so. Even if the insured never wanted the consequences of the act and/or omission.
2 Who are insured?
2.1 If the policy schedule states that this insurance applies to a multi-person household, then the following are insured:
2.1.1 you;
2.1.2 your spouse or registered partner;
2.1.3 your cohabiting unmarried children, including foster and stepchildren;
2.1.4 your adult unmarried children, including foster and stepchildren, if they are living away from home to follow an education;
2.1.5 other persons with whom you live together permanently and as a family unit;
2.1.6 your grandparents, parents, foster parents, parents-in-law and unmarried relatives living with you;
2.1.7 guests. Only if their liability is not covered by another insurance policy;
2.1.8 domestic staff during the work they perform for you.
2.2
If the policy schedule states that this insurance applies to a single-person household, then only the following are insured:
2.2.1 you;
2.2.2 guests. Only if their liability is not covered by another insurance policy;
2.2.3 domestic staff during the work they perform for you.
3 Capacity in which insured
3.1
The liability of the insured as a private person is covered. Damage caused during the exercise of a (ancillary) business or (ancillary) profession and the performance of paid work is not covered.
3.2
These limitations of capacity do not apply to:
3.2.1 Domestic staff as described in art. 2;
3.2.2 insured persons as described in art. 2.1.4 to 2.1.6 when they perform work for others than the insured during holidays, free time or within the framework of an education, whether or not for payment. In this case, the liability of these children is only covered if their liability is not covered by another insurance policy. Claims of the employer are not covered;
3.2.3 insured persons who perform unpaid volunteer work for others than the insured.
4 What is covered?
4.1 Liability
The liability of the insured persons for damage caused or arisen during the term of the insurance is covered, and this is for all insured persons together up to a maximum of the amount stated on the policy schedule per event.
Liability for damage caused during the term but arising after the end of the insurance is covered, but only if the liability for this damage is not covered by another insurance policy.
4.2 Mutual liability
Liability for damage caused by an insured person to another insured person is covered. Insurers only compensate damage to persons. Damage to property is not covered. Only the injured insured person themselves or a surviving relative of this insured person will receive compensation.
If the domestic staff has an accident at work while performing work for you, insurers will compensate damage to persons in addition to damage to property.
Does the policy schedule state that the insurance applies to a single-person household? And the insured causes damage to another person with whom the insured lives together permanently and as a family unit? Then insurers only compensate damage to persons. And only if the damage is not covered by another insurance policy.
4.3 Friendly service
Damage caused by the insured when performing a friendly service (favor) is covered. This concerns damage to the person or property of the person for whom the insured is performing the friendly service.
By friendly service, insurers mean work that the insured performs for another private person, without being paid for it.
Insurers compensate this damage up to a maximum of EUR 12,500 per event, but only if:
- the friendly service is performed for someone other than an insured person, and
- the insured would be liable if there were no friendly service, and
- the damage was not caused by the injured party's own fault, and
- the compensation is requested by the person who was helped with the friendly service, or a surviving relative of that person.
4.4 Defense in human civil proceedings
Are you held liable for damage and must you defend yourself against this in civil proceedings? Then insurers will compensate the costs. There is no maximum for this. However, insurers must be in charge of this process.
4.5 Statutory interest
Insurers compensate the statutory interest you have to pay. There is no maximum for this. Is the total damage higher than the insured amount for liability? Then insurers will not pay statutory interest on the amount above the insured amount.
4.6 Guarantee deposit
Does a competent authority request a guarantee deposit to secure the rights of the injured party in the event of insured damage? Then insurers can advance this guarantee deposit. Insurers pay the guarantee deposit up to a maximum of 10% of the insured sum.
If insurers advance the guarantee deposit, you are obliged to authorize insurers to recover the guarantee deposit when it is released. And furthermore, to provide all cooperation to get it fully repaid.
Is the guarantee deposit not released? Then you must repay it to insurers as quickly as possible, but at the latest within 12 months.
5 Immovable property
5.1
For immovable property, only your liability or that of the cohabiting insured persons is covered:
5.1.1 as the owner-occupier of the home including the associated outbuildings in which you live, even if part of it is rented out;
5.1.2 as the owner of the home that is no longer occupied by you, but which you still own;
5.1.3 as the owner of the home that you own, but where you do not yet live;
5.1.4 as the owner of a holiday home, mobile home, cabin on an allotment garden complex or a second home located in Europe. But only if you occupy it yourself and do not rent it out exclusively to third parties;
5.1.5 for damage caused by the home under construction in which you will live yourself. But only if the liability for the damage is not covered by another insurance policy.
5.2 Liability for damage caused by immovable property that you rent out is not covered.
6 What is not covered?
The General Terms and Conditions state the general exclusions. In addition, insurers do not compensate damage in the following situations:
6.1 Intent
Liability for damage is not covered
- which the insured causes intentionally.
- which someone causes with the approval of the insured.
- which is caused intentionally by one or more persons from a group to which the insured belongs. It does not matter that the insured did nothing themselves. Nor does it matter if the insured or others from the group were under the influence of alcohol, medicines or drugs.
6.2 Sexual conduct
Liability is not covered:
- of an insured person for damage caused by and/or arising from his/her sexual or sexually tinted conduct of any nature whatsoever.
- of an insured person belonging to a group for damage caused by and/or arising from sexual or sexually tinted conduct of any nature whatsoever of one or more persons belonging to the group. Even if the insured did not behave as such themselves.
6.3 Custody (Opzicht)
6.3.1 Liability for damage to property belonging to someone else that of which the insured has custody (opzicht) is not always covered. Damage to the following property is not covered:
6.3.1.1
to property (excluding animals) which the insured or someone on behalf of the insured has in their possession on the basis of:
- a rental agreement;
- a hire-purchase agreement;
- a lease agreement;
- a (ground) lease agreement;
- a pledge agreement;
- usufruct;
- the right of use and habitation
- the exercise of an (ancillary) business;
6.3.1.2 to property which the insured or someone on behalf of the insured has unlawfully in their possession.
6.3.1.3 to motor vehicles, (mobile) homes, motor and sailing vessels (including sailboards) and aircraft, which an insured person or someone on behalf of the insured has in their possession;
6.3.1.4 which consists of and/or is the result of loss, theft or misplacement of money, securities, bank, giro or payment cards or credit cards, which an insured person or someone on behalf of the insured has in their possession.
6.3.2 The exclusions mentioned in articles 6.3.1.1 to 6.3.1.3 do not apply in the following situations:
- 6.3.2.1 if damage is caused to a home or (mobile) home rented by the insured by a (satellite) antenna attached by the insured to that rented home or (mobile) home;
- 6.3.2.2 if damage is caused to a home, (mobile) home, trailer, folding caravan, boat trailer rented by the insured by fire, fire extinguishing or explosion. This also applies if this causes damage to property belonging to the home and (mobile) home rented by the insured;
- 6.3.2.3 if damage is caused to the holiday accommodation rented by the insured by water unexpectedly flowing from pipes, installations and appliances in the holiday accommodation. This also applies if this causes damage to property belonging to the holiday accommodation rented by the insured;
6.3.2.4 if the insured, as a passenger of a means of transport, causes damage to that means of transport. This only applies if the insured does not have a rental, hire-purchase, lease or other agreement for that means of transport.
6.3.3 The liability of the insured for damage to a motor vehicle with which joyriding has been committed is not covered. Is the person who caused this damage under 18 years of age? Then the damage to that motor vehicle is covered. Insurers compensate this damage up to a maximum of EUR 5,000 per event.
6.3.4 Is the insured liable for damage caused to someone else's property that the insured has custody of (opzicht)? And does this concern a different situation than stated in art. 6.3.1 to 6.3.3? Then insurers compensate the damage up to a maximum of EUR 12,500 per event.
6.3.5 Insurers will not invoke the exclusions and limitations regarding custody as described in art. 6.3.1 to 6.3.4, in case of liability for damage caused by an insured person who is under 14 years of age, unless an insured person of 14 years or older also has the property under custody.
6.4 Motor vehicles
6.4.1 Liability for damage caused with or by a motor vehicle owned, possessed, kept, driven or used by an insured person is not covered.
6.4.2 This exclusion does not apply in the following cases:
6.4.2.1 if the insured causes damage as a passenger of a motor vehicle. However, Art. 4.2 (mutual liability) and art. 6.3 (custody) remain fully applicable;
6.4.2.2 if your domestic staff and the insured persons mentioned in art. 2.1.2 and 2.1.3 cause damage with their own motor vehicle during the work they perform for you;
6.4.2.3 if the insured causes damage with lawnmowers, children's toys or other utensils with a motor. But only if these cannot drive faster than 10 km per hour. Liability for damage caused with remote-controlled model cars is also covered.
6.4.2.4 if the insured causes damage with or by a bicycle with electric pedal assistance for which no insurance obligation applies;
6.4.2.5 if the insured causes damage during joyriding with a motor vehicle. But only if the person who caused the damage is under 18 years of age. And the cause of the damage moreover did not want to steal or embezzle the motor vehicle.
Is there joyriding without violence? And does the owner of the motor vehicle have liability insurance for their motor vehicle? Then the liability for damage caused with or by the motor vehicle is not covered.
6.4.3 The cover described under art. 6.4.2.1 to 6.4.2.5 does not apply if the liability is covered by another insurance policy.
6.5 Vessels
6.5.1 Liability for damage to property caused with or by vessels is not covered.
6.5.2 This exclusion does not apply in the following cases:
6.5.2.1 if the insured causes damage as a passenger of a vessel. However, Art. 4.2 (mutual liability) and art. 6.3 (custody) remain fully applicable;
6.5.2.2 if the insured causes damage with or by:
- a rowboat, canoe or other vessel without a motor;
- a model boat, even if it is remote-controlled;
- a vessel that has an (outboard) motor with a power of 3 kilowatts or less (3 kilowatts is approximately 4 hp) and cannot sail faster than 20 km per hour;
- a sailboard and sailboat whose sail area is not larger than 16m2;
- a houseboat without a motor.
6.5.3 Liability for damage caused with or by a vessel that has an (outboard) motor and can sail faster than 20 km per hour is not covered.
6.5.4 The cover described under art. 6.5.2.1 and 6.5.2.2 does not apply if the liability is covered by another insurance policy.
6.6 Aircraft
6.6.1 Liability for damage caused with or by an aircraft is not covered. This also applies to damage caused with or by a:
- a model airplane;
- a glider;
- a target aircraft;
- a paraglider;
- a kite (tethered);
- an airship;
- a model rocket;
- a hovercraft;
- a hot air balloon whose diameter is larger than 1 m.
6.6.2 This exclusion does not apply in the following cases:
6.6.2.1 if the insured causes damage as a passenger of an aircraft. However, Article 4.2 (mutual liability) and art. 6.3 remain fully applicable;
6.6.2.2 if the insured causes damage with or by model airplanes that weigh 20 kg or less;
6.6.3 The cover described under art. 6.6.2.1 and 6.6.2.2 does not apply if the liability is covered by another insurance policy.
6.7 Residence not in the Netherlands
6.7.1 The liability of an insured person who no longer has his/her residence in the Netherlands is not covered. The insurance ends for him/her 30 days after departure.
6.7.2 This exclusion does not apply to guests and domestic staff.
6.8 Weapons
Liability for damage caused in connection with the possession and/or use of weapons as referred to in the Weapons and Ammunition Act, for which the insured does not have a license, is not covered.
Liability for damage caused in connection with the possession and/or use of firearms during hunting is not covered. Even if the insured has a license for this.
7 Handling of a claim
7.1 Claims settlement
Insurers have the right to settle claims of the injured party directly with that injured party. Insurers can compensate the damage directly to the injured party or reach a settlement with the injured party. In doing so, insurers take your interests into account.
7.2 Compensation
Does the compensation of damage consist of periodic payments? And is the value of the payments, taking into account any other compensation, higher than the insured amount? Then the duration or the level of those payments will be reduced proportionally.
8 What happens in the event of death?
8.1
If you pass away and the policy schedule states that this insurance applies to a multi-person household, the following rules apply:
8.1.1 Did you have a spouse or partner? Then the insurance continues unchanged in the name of this spouse or partner.
If the spouse or partner does not wish to continue the insurance, they must let the insurers know within three months of death.
The insurance then ends on the date indicated by them;
8.1.2 Did you not have a spouse or partner? But you do have children under 18 years of age? And is there a guardian for these children? Then the insurance continues unchanged in the name of this guardian.
If the guardian does not wish to continue the insurance, they must let the insurers know within three months of death.
The insurance then ends on the date indicated by them;
8.1.3 Did you not have a spouse or partner? And also no children under 18 years of age? Then the insurance ends at the end of the period for which the last premium was paid.
