Article 1: General

We process your personal data on the basis of at least one of the following legal bases:

Article 2: Privacy statement User

If you, as a user, book a babysitter though the platform, Charly Cares collects the following personal data and information necessary to perform the services you have ordered. We store this information in a parent profile that is accessible to you, which can be edited:

1. Identity and contact details, such as first name, last name, email address, phone number, address information, family composition, and preferred payment method;

2. Bank and payment information, such as account holder, bank account number / IBAN, bank identification number;

3. The nature of services booked, as well as the duration of the services booked in hours; information regarding the uniqueness or repetition of the service;

4. The time of creating and updating the parent profile;;

5. The number of children you have and the month and year of birth of your child(ren);

6. Optional and insofar as you have passed these on to the babysitter via the chat: particulars regarding the children (such as allergies, dietary requirements, bed times and the like), your preference regarding how the babysitter enters the house (are you at home yourself or, if the babysitter has already been there before, a third party), possible presence of pets, etcetera;

7. Optional and only with your explicit permission: profile picture of your family;

8. Chat history with babysitter;

9. Data from linked social media accounts, whereby befriended Charly Cares users can see each other within the app;

10. Other data, such as IP address, login information, navigation behaviour.

Charly Cares uses the aforementioned data for the establishment of a booking(request) for a babysitting service by a babysitter. In addition to the age of the babysitter, his or her experience, skills, and the travel distance to the babysitting address will be used. Date and year of birth of the children are processed because children under the age of 2,5 are only matched with a babysitter with specialised knowledge.

If the activities of Charly Cares lead to the conclusion fo a Babysitting Agreement between you and a babysitter, Charly Cares will process and use the details of your parent profile as further described in the applicable "general conditions for babysitters", with the aim of facilitating the invoicing and the necessary aftercare, as well as the invoicing of the commission by Charly Cares to the babysitter.

If you avail yourself of the opportunity to review completed babysitting services on the platform, Charly Cares will collect, process, and use the data you enter to display it on the platform. In addition, Charly Cares will store the service booked by you and completed by a babysitter, as well as the invoices drawn up on behalf of the babysitter, in your parent profile, in order to provide you with access to this information at a later time.

In the context of our service, we can contact you by phone to assist you with making a booking or to personally explain our services and answer questions.

Existing customers (with a login) will receive commercial communications from Charly Cares, for which information from your parent profile, bookings, and additional information as well as you parent profile login times will be collected, processed, and used by Charly Cares, in order to better understand your parent preferences and to offer you possibly interesting information for further services. You can unsubscribe at any time by clicking "Unsubscribe" in the email.

You can also change the additional information and data in your parent profile at all times in your parent profile. Your data will be stored for as long as your account remains active. If you delete your parent profile from the platform, Charly Cares will block and permanently delete your data.

The aforementioned use and processing of your personal data by Charly Cares will only take place insofar as this is necessary for the linking or aftercare of the babysitting service between you and a Babysitter, or insofar as further use is regulated or permitted by this privacy statement.

Article 3: Privacy statement Babysitter

If you register as a babysitter on the platform, Charly Cares will, among other things, obtain, process, and use the following personal data from you to provide the services that you have requested. This processing is necessary to establish a match and possibly a Babysitting Agreement between you as a babysitter and a user:

1. Identity and contact details, such as first name, last name, email address, street, zip code and city, date of birth;

2. Bank and payment information, such as account holder, bank account number / IBAN, bank identification number;

3. Information regarding your references, in what nature and to what extent you have experience as a babysitter, information regarding the means of transportation which are available to you, a (possible) Statement of Conduct, your bank account number, your knowledge of the Dutch language (or knowledge of other languages), information about the work area and working hours that are possible for you, and the ways in which to contact you (mobile phone, mobile phone with internet access, internet access);

4. Profile picture (which will only be made public after your explicit permission);

5. Chat history with users (parents);

6. The nature of services booked, as well as the duration of the services booked in hours; information regarding the uniqueness or repetition of the service;

7. The time of creating and updating the babysitter profile;

Charly Cares stores the aforementioned data in a babysitter profile accessible to you, as part of the invoicing of the babysitting activities linked to the babysitter by Charly Cares.

If a user on the platform avails themselves of the opportunity to review the babysitting services completed by you, Charly CAres will collect, process, and use the informatino entered by you in order to display it on the platform. Charly Cares may make use of the payment services of ABN AMRO Bank N.V. (ABN AMRO) in order to process payments to you.
